THE TRUSS MARKING RULE DEADLINE HAS PASSED!

Many companies are still not in compliance with the new Truss Marking Rule that went into effect in December of 2009, which required new signage by March 13, 2010 on  properties of 3 or more units where the roof or floor trusses are of “light frame” construction, and there is a REAL good chance your apartment community, condominium or even triplex has wood or light gauge steel truss construction buildings present. Are you risking massive fines by not being in compliance? Are you putting firefighters at risk? Is this all new to you? This is not something that you want to ignore.

FIGHTING CRIME AT YOUR PROPERTY

Josie, one of your residents, has just marched into your office. She thinks that she may have witnessed drug dealing last night at the pool area. You do not see anything in the lease which deals with criminal conduct violations.  You call your attorney for guidance, but the attorney is “unavailable”, and nobody in that office will be able to assist you. You asked Sam, the “Courtesy Officer”, if he saw anything. Sam replies by telling you that watching the pool area “is not his responsibility”.  Next, Walter, Armando and Pam enter the office and threaten to leave your community unless you “fix” your crime problem. You have a very limited budget. Is this a hopeless situation?

THE CENSUS AND THE LANDLORD

There is someone in your office.  He wants to talk to you.  He wants to visit your residents.  He is seeking to complete census questionnaires.  If he is unable to collect the information from the residents, he will be returning to the office to collect the information from you.  Ordinarily, you would never disclose the information that he is seeking, as to do so would be a clear violation of the residents’ privacy.  Are you required to allow the census taker to go door to door on your property?  Are you required to supply the resident information that the census taker wants?  Can you be liable for doing so?

SECURITY DEPOSIT QUICK TIP

While you have a full 30 days to send your former resident(s) the Notice of Intention to Impose Claim on Security Deposit if you are claiming all or part of the deposit, you must remember that you only have 15 days to return the security deposit to the former resident if you are NOT making any claim. Many larger management companies are failing to process the deposit return fast enough or think they have 30 days. While failure to abide by the time limits rarely result in litigation, it is important to do it right!
