Marc
Rosenwasser, President and CEO of Meadow Wood Property Company,
Tampa, Fla., was installed as 2010 National Apartment
Association (NAA) Chairman of the Board at the NAA Assembly of
Delegates meeting Nov. 14 in Tampa.
Marc is past President of both the Bay Area Apartment
Association and the Florida Apartment Association, and we are
proud and honored to have him as our NAA Chairman.

PARTNERS WITH ORLANDO POLICE DEPARTMENT TO BRING CRIME FREE
MULTI-HOUSING PROGRAM TO CENTRAL FLORIDA |

Apartment Association of Greater Orlando (AAGO) and The Orlando
Police Department (OPD) partnered to bring The Crime Free
Multi-Housing (CFMH) program to central Florida. CFMH is an
internationally recognized and certified program founded in 1992

CONSTRUCTIVE EVICTION AND RETALIATION
|

Your
most difficult tenant, Larry, “voluntarily” vacated the
premises. Later that day, you learn that Moe, your second most
difficult tenant, failed to renew his lease. Therefore, you
decide to send Moe a non-renewal notice. You are thrilled! As
you reflect back, you wonder how Larry was able to stick around
with all of the problems he had with his apartment. When Larry
sent you a letter earlier in the month asking you to repair his
air conditioner and shower, you thought big problems were
ahead. Moe was a rebel rouser. He conducted tenant meetings.
Afterwards, service requests for the apartment community
increased by over 80%!

THE BASICS
OF COMPLETING THE SECURITY DEPOSIT CLAIM |

Our
office sees hundreds of security deposit claims in the course of
advising clients. They are called many different names:
Statement of Deposit Account (SODA), Notice of Claim against
Security Deposit, Move Out Reconciliation and Claim, etc. By
whatever name the common purpose is to make a claim against the
security deposit that will comply with Florida law and withstand
any legal challenge by the tenant. All too often we find an
otherwise valid claim is lost by the improper completion of the

UNAUTHORIZED
OCCUPANT QUICK TIP |
|
You
were notified that a tenant has an unauthorized occupant in the
unit. You decide you want this person removed, but find out that
your assistant has accepted rent checks from the unauthorized
occupant for 3 months. What happened? You most likely
inadvertently “authorized” the unauthorized occupant, now making
it very difficult to evict the tenant for unauthorized
occupancy. Be very cautious who you accept rent from, no matter
how busy or desperate you are.

DOGS AND
INSURANCE |
|
Your
owner tells you that he will permit a pet dog “as long as it is
not too big”. You approve the application, even look at
the pet as you should, and the tenant and his pet moves in. A
month later, the pet knocks an elderly woman down who breaks a
hip, acquires an infection in the hospital and dies.
Insurance will cover it, right? Don’t be so sure. That cute dog
you are allowing on the property could be a great liability to
you and the property owner.

INDUSTRY LEADER OF THE MONTH - KYM OTTAVIANI

Coming
into the property management field in 1980 by tearing buildings
down, Kym was an urban miner working with a company that did
salvage work prior to demolition in Clearwater. Buying houses
and living in them as they were being remodeled, he then brought
in roommates, renting bedrooms. By 1983 everything was lost
financially, but the seed to manage was sown. Earning a real
estate license, Kym went to work selling houses when 18%
interest was the norm and not a lot was selling, so he put
together an investment group and started remodeling houses
again. By the mid 1980’s with a COMMODORE 64 computer and a VCR
camera in hand, property management was the mainstay of
business. He offered to investors the full package; the sale,
complete renovation, tenant placement and monthly oversight with
accounting. In 1995 a new start up company was formed; REX
RENTALS & REALTY, INC. Kym’s business model is to gain the trust
and respect of the client through daily hard work. Kym firmly
believes in education and staying on the cutting edge, attending
educational seminars and networking; he is a firm believer in
giving to the property management community, serving as the 2010
President of the Tampa Bay Chapter of the National Association
of Residential Property Managers (NARPM).
